Car Insurance Question

My wife got involved in a Car accident a couple of years ago... Nothing major, she was waiting to turn into her parents road, a car pulled out, and hit her in the side - Its basically been dragging on for a while, and is likely to go to court, because the other person involved refuses to take any of the blame, sadly no dashcam footage either.

She got a Hire Car through her Insurance Company whilst the repairs to the Car was being done.

She's now being chased for £8k for those repairs, and for the hire car fee... Surely all this should be something that the Insurance Company should be dealing with (They instructed the company in question to make the repairs... Not us), and other than the excess, is something that my wife shouldn't have to be paying surely?

Any advice would be greatly appreciated?

    Our insurance company authorized the repairs, and hire car.

     We then got a letter from a solicitor saying we need to pay £5k for the repairs etc as the bills are still unpaid 

    I got straight onto my insurance company basically saying WTF and the bloke just laughed and said throw it in the bin 

    I asked him what was going on and he said it’s common practice for insurance companies to not pay until this sort of thing happens so they can keep the payouts down 

    He finished by saying he will push a button and the payment will be made

    Cheers mate... this is exactly what I thought...

    Am not surprised that Diamond (the Insurance Company) havent paid Auxillis, because I imagine they're hoping that the third party gets the blame in court, and its their Insurance Company that'll just have to pay Auxillis instead

    Call the insurance company, I assume she had comprehensive cover? And check what you signed at the time of the claim, it wasn't passed to a third party to deal with was it?

    Yeah definitely has comprehensive cover, certainly wasn't passed to a third party to deal with... She's always had contact either with Diamond (Insurance Co.) / Admiral Law / Auxillis (the Repair / Hire Car Co.)
  • Did your wife definitely ring the insurance company using the claims number on her policy documents ? 

    I've heard of cases where people Google the number (partly in panic) and ring the first number that comes up that includes the Insurance Co.name. it then transpires that they have actually rung a claims management company and they sort out the repairs & hire car.

    I'd check about Auxillis and Diamond. They are a completely separate company that usually agree to deal with your 'non fault claim' if you don't want to go through your insurance, Diamond would have given you two options. Diamond deal with it, you pay excess etc, or pass it out to a third party. Sounds like the latter.

    You need to check what you signed at that point and what you may/may not be liable for.
