Speeding ticket help please

Just received a "notice of intended prosecution" through the post. My problem is that the form only allows you to either own up or finger someone else - NOT to ask for the evidence.

It says I was going westbound (ie. towards London) in the Limehouse Link Tunnel on a Thursday evening 2 weeks back at 6pm. I'll freely admit I was in the area at about 2pm (Blackwall Tunnel & then the A13 out to Thurrock), but I came home via the Dartford Brdige & A20 so wouldn't have been anywhere near there at 6pm.

There are no contact details anywhere on the form apart from the address to send it back to.

Has anyone else had any experience of this/managed to request the pictures? Surely I have the right to question things before they start court proceedings...

Any help gratefully received!

  • find a friend overseas and pass the blame all they do is send the other person a letter. Iv had one or two since i moved to Ireland!

    WSS: That's my problem - there's no way to ask!
  • I would suggest sending a letter back asking for photographic evidence as you do not believe you were in the area at that time. I have done this before when I wasn't sure if it was my husband or me driving the car.
    Some police forces have a website you can log on to and view the photographs.

  • If you really weren't anywhere near where the authorities claim your vehicle was speeding, it sounds to me your vehicle may have been cloned.

    They've issued the NIP to identify the driver. If the car wasn't in the area at the time then I think you have to ask why they think it was. No doubt it's a speeding camera if it's the Limehouse Link.

    What if the incorrect details eg model of car, road name have been quoted on the NIP?
    If the matter can be identified, regardless of the error, then you still have an obligation to reply. If the error means that you are unable to substantiate the allegation, you should return the Notice asking for clarification. An error would not immediately mean the Notice is null and void.

    Can I demand the photographic evidence?
    When issuing a NIP, there is no obligation upon the Police to release photographic evidence but many Police forces will supply same on request. Several Police forces allow you to inspect the photographs on the internet.

    There are an increasing number of cases where registration numbers have been read incorrectly or vehicles have been "cloned" by using duplicate number plates. If you feel you fall into this category, you should reply to the NIP by stating that you believe the information is incorrect and that you can establish where the vehicle was at the time of the alleged offence.

    for motoring issues. Somewhere on those sites there's a lawyer who specialises in defending motoring offences. I think pepipoo has a NIP wizard which runs you through the processes.
    But if you really weren't there, there's a small chance your vehicle may have been cloned and you need to see the evidence from the scamera.

  • The time on their clocks have to be accurate too i think for the ticket to stick, and maybe wasn't in this case

    Re. the time - it doesn't matter really as I never actually drove on that road that day!

    If I'd actually done this, I'd be a bit pissed-off for being stupid, but I'd hold my hands up & take the penalty....but I didn't do it.

  • I challanged a ticket recently and they finally admitted that they had the incorrect registration number, so don't take the penalty.

    I'd go with the "finger someone" option
  • Did you pay at the Dartford Bridge or do you have a Dart-Tag? If you have a tag you can go on the Dartford Toll Web Site and it shows when it was used.

    I di this once and got a photo back very quickly. Sadly, it clearly showed me driving so I couldn't pin it on the missus as planned. Worth asking.

    I've managed to find an email address hidden away in the depths of the Met Police website. Will follow it up with a recorded delivery letter asking for the pics.

    Have you had your number plate stolen ? Mine were stolen a couple of years ago & I was told it was becoming more common. (I had no come back/problems).
  • Covered End - No, they've not been stolen. I'm hoping that it's simply a case of whoever looked at the pic from the Gatso simply made a mistake reading the plate, though I'm a bit worried about cloning...

    Seriously - ask them for the evidence. If it wasn't your car, but was your registration, you;ve been cloned - and can expect this (or far worse) to happen again. Most ANPR systems nowadays are pretty accurate, so the chances they've made a mistake with your number plate are pretty slim (unless they're cheapskates and employ actual people to do the checking (far more prone to error))

  • coming up to xmas - Met police need extra funds for presents.
  • I do not think you have been cloned because if it had you would probably find that it has also been used in the congestion charge zone and received a ticket for that as well.

  • The cameras in the Limehouse Link are digital and part of an automated system. The tickets are automatically generated. They are also average speed through the whole stretch. They left the old cameras in place which fools some people. Beware.
