The difficulty in any debate here is that we forced out Doc
I don't think Doc was necessarily forced out by Ouma. Skipp was signed after the Chalobah injury, after Ouma was signed and before Doc was released.
    He was 100% forced out
He wasn’t good enough .  The fact that some of the others aren’t either doesn’t contradict that.
Exactly. It’s called the Charlton life affect,….. player isn’t good enough and needs to leave, he leaves and is remembered  as Ronaldo

the other side of the Charlton life affect coin

weve signed the best player in the world, two months later - our recruitment is worse than oxfords!

I think going AWOL would be considered a breach of contract surely.
So as some know I work in the legal field mainly around cyber security and technology instead of employment law, however I can say with an almost 100% certainity being absent without notice or permission which causes the party to be unable to fulfill the required duties of a contract would be a breach of contract
It will be a breach, whether it's a sufficiently serious breach to mean they can cancel the contract and not eg pay any of the money they would otherwise owe is a different question
So typically in a situation like this the details will matter but its pretty clear cut. The first question is if a breach of contract occured? As already discussed the answer is yes. 2nd Question is why has the breach occurred? Well the answer is he is not fulfilling the duties he has been contracted for. 3rd Question is are there any extenuating circumstances that have caused him to not be able to fulfill the duties he is contracted for that are beyond his control? We do not know but guessing NJs comments it seems unlikely. The only possible sticking point is as Ouma has history for this behaviour, has his parent club included any clauses or wording that absolves them of responsibility should he go AWOL.

Maybe Charlton Athletic had not issued Timothy Ouma with a club telephone.
He might then have been stuck somewhere with a very slow and unreliable postal service, and his letter to the club is yet to arrive.
We gave him a phone contract but due to cost cutting he only has 3G

I know you're joking and we definitely didn't miss him  but we did miss a dynamic forward who will drive with the ball which is who he was meant to be

Still no news so presumably there's stuff happening in the background - but if he failed to return after the internationals this would, in the real world, be a fairly simple case of breach of contract and we should be able to terminate.  If we didn't put a clause in or it's not in the standard loan ts & cs then that's pretty amateurish on our part.  But seeing as it's football and it's a disciplinary matter he should be given the opportunity to explain and probably face a fine rather than get sacked.

The official FIFA rules state he has 48 hours from the end of the international window closing to return to his club as they play outside the UEFA zone (where it would be 24 hours).  There can be individual agreements made in some circumstances.

The FIFA window officially ended on 6th October so he should have been back by 8th at the latest.  I doubt if we will ever find out exactly what transpired.

It most likely wouldnt be on our end if it wasnt included. Its pretty much boiler plate in employment law. The only problem I would forsee is if his parent club stipulated it.

Thinking about this and playing devils advocate - and it's not something I have heard at all - but maybe Ouma has other issues we aren't aware of.  Perhaps he's struggling to settle in London, his mate Sichenje may not be around much owing to his rehabilitation so Ouma is a bit isolated.  He flies home to play for his country, spends time with family and has some sort of breakdown because he can't bear the thought of returning to England where he maybe feels out of his depth and hasn't hit the ground running.  He is only fairly young so its not impossible.  There are so many potential scenarios that could be happening here.

I hope he gets the right advice and gets his career sorted.

On the 18th December he finally reappears, and because of an injury crisis goes straight into the team to face Millwall the next day, where he plays like prime Keane/De Bruyne/Zidane, dominating the game and scoring the winner as  Charlton get their only win at The Den in the 21st Century.

His statue replaces the Sam Bartram one, which is moved to outside the Covered End toilets.

I know as fact that he was connected with some unsavoury individuals whilst in Sweden with Elfsborg.

Can you elaborate at all? @elf@ElfsborgAddick

I know this isn't the first time he's done something so it might well be he has the wrong people around him.  Sounds like he needs someone like a Tracey Leaburn looking after him and keeping him on the straight and narrow

  • When this is the 4th time in his career that he's reported back late the only conclusion to make is that he simply doesn't give a fuck.

On one of the occasions he reported back THREE WEEKS late claiming he had visa issues. Another time he didn't report back and was then given permission for extended leave to deal with 'personal matters' and then still reported back after the extended date.

He is either incredibly unlucky or he's a massive piss taker. I think i know which one.
