For those of you calling for Bellamy to sue - The law regarding defamation, both slander and libel, refers to words "likely to lower the standing of the recipient in the eyes of his peers". Or words to that effect; perhaps a legal Lifer can quote chapter and verse. So, who precisely is defamed by Kiely's alleged remark? Bellamy? Bellamy's mother? His grandmother? There's no case.

No................ People are not saying Bellamy can sue, they're saying that if the allegations in the book are not true, Keily can sue Bellamy!
    Er. Yeah.
Yeah, I'm making the point to Viewfinder!
    Got it, Big Rob!

    Eureka!

    Bye....
  • I see the black caps are coming out on here again.
  • Kiely, being a nice bloke, probably just isn't very good at insulting people. So when he wanted to insult Bellamy he was out or his comfort zone.

Reminds me of the incident in the inbetweeners when Simon is talking dirty and goes a bit too far and comes out with " I want to f*** your f***ing fanny off, you t* **"

I don't believe it for a second. Absolute rubbish.

So why has Kiely not sued him if its untrue?
Wow. That really does sum up the attitudes of a society that has forgotten how to talk, reason and is desperate to squeeze money out of every thing and person they can. Maybe because our suing culture has not yet reached American levels yet? Maybe because he doesn't want to bring further attention to it? Maybe because it's only just come out yet and he hasn't started proceedings yet?
I am not suggesting Kiely should or shouldnt sue, thats for him to decide based on the facts as he sees them. As somebody else stated, the lawyers would have been all over the draft of his book before release, and the fact that Kiely apologised on the phone over the loudspeaker in front of witnesses (allegedly), they would be very bold and scathing statements to make by Bellamy if untrue and he couldn't back them up (i.e. the phone witnesses).

  • Some interesting views on this thread. For me, yes he probably said it and I suspect that there's some history between the two underlying it, that may have played a part. Highly inappropriate on Deano's part, absolutely 100%, and equally I suspect Deano knew instantly he'd crossed a line but didn't handle it well. Not going to defend him at all.

What I struggle with to an extent is that there will be people castigating Deano for this who will happily stand there screaming dogs abuse at players AND their family. I am not equating the two at all but to call Mrs Murphy a whore is also highly offensive behaviour to me (and him presumably) but was written off as "banter". What I'm saying is that I struggle to understand some peoples moral compass I suppose.

I think the "justification" in the case of the Murphy woman is that she allegedly said some derisory things about both Charlton and Charlton fans prior to the "whore" incident.

I'm by no means saying that makes it right but it does offer a perverse logic as to why it happened.
  • I don’t buy the argument that what was written must be true, because it wouldn’t have been published otherwise. If you want proof that not everything we read is true, just pick up a newspaper. All publishers and newspapers have libel lawyers check what they print before it’s printed, but plenty still end up being successfully sued for defamation.

That’s not to say what Bellamy wrote wasn’t true – it’s possible that it was – but it’s false to conclude that what he wrote was necessarily true just because it was published.

As for why Kiely hasn’t sued, none of us has clue, so I don’t really see that any conclusion can be drawn from that either.

Maybe what Bellamy wrote was a lie, but Kiely’s decided to rise above it. Or maybe he doesn’t even know about it yet. Maybe he wants to sue, but can’t afford to. Maybe he is suing, and we just don’t know about it.

Or maybe what Bellamy wrote was true, but Bellamy had said something equally repugnant to Kiely immediately beforehand. That wouldn’t necessarily excuse what Kiely said, but would put a very different spin on things.

Perhaps what Bellamy wrote was the entire truth, and Kiely succumbed to a moment of human frailty that he’s regretted every since. Or maybe Kiely’s a horrible, horrible person and says stuff like that all the time.

No one on here really has any idea, but a lot of people somehow seem very certain about it all.
  • Whatever way you paint it. If it was said then there is no possible excuse or mitigation.
  • This thread is literally unbelieveable. I cannot believe there are 3 pages of discussion on something someone said during a football game 10 years ago.

Roll on the start of the season.

I blame whoever started the thread.

    Oh, hang on........
  • Shitty comment, but I think most on here don't realise how far detached from reality the football dressing room can be, and the levels that 'banter' will go to.

Said things in my life that I've regretted forever and have ruined friendships, so I'm not going to criticise others too harshly without knowing the full story.

On a similar vein, we were playing a game at Danson once, my centre half had been having a bit of a run in with their striker taking it in turns to go in a bit late. been going on a bit and as the striker was getting up off the floor, my defender put his hand out to shake his hand. Just as the other bloke was about to shake his hand, my defender raised his hand, stuck two fingers under the blokes nose, and offered him to "smell his mum".

All hell broke loose, and just our luck they had three brothers playing for the same team. You still back your own though in the heat of the moment, even when you know they are in the wrong.

...it's only a game after all.

    And a performance based job.
If saying that makes Bellamy miss the net then..

    Wow
MattD, have a think about you would feel if someone at you work said something to you along the same lines?
    Bit pissed off probably.
Would just take it with a bit of salt and go in studs up on him next time.
  • righto
  • I dont get this

If someone says i hope your mum dies of cancer

The only reaction is to crack them straight where the word came from

However he with no sin and all that

I have said shocking things but i can 100% say that i would never say that

Remember the outrage on here when that smallwill prick said somrthing shitty to VG about his daughter

So there are people that do not think about what they say before it comes out

    @rina

Ha, did you really need to guess :-)
  • I am a cancer survivor .. so far .. and if anyone, Charlton 'legend' or not said anything like that to my face, or behind my back for that matter, I would smack him VERY hard
