If the Judge does not believe there is an imminent sale why does he think any one is in court trying to get or prevent an injunction to stop a sale happening?
The case is going to trial come what may - the issue is whether to grant an injunction to prevent a trial beforehand. That is why they have been making submissions about whether damages are a suitable resolution - if so, no need for an injubction to prevent the sale.
This is ridiculous. What would you, lock him away and forbid he gives evidence? He is the incumbent and it fell to him to provide the submission presumably through others to the court.
